Agreement for use
Contents License Agreement The National Institute of Advanced Science and Technology, hereafter referred to as "the first," permits a user of this software, hereafter referred to as "the second," to use this software, if the second carefully reads this agreement, and only if the second accepts this agreement. Signing to this agreement or getting the contents means that the second accepts this agreement. Condition for Using Contents (Display of the Administrator's name, Software Name and Administration Number) Paragraph 1 The first determines "Tetsuya Baba, Chief of Material Properties and Metrological Statistics Division" as the administrator of the contents, "Thermophysical Property Data" as the name, and "H15 PRO 156" as the administration number. When the second uses this software, the second needs to specify the first' works, the administrator, the name, and the administration number. (Limitation of Usage) Paragraph 2 The second should not develop upon or improve the contents. Neither should the second use this software to appraise its commercial value. When the second produces and sells this software, the second should conclude the license agreement through the designated technology licensing organization and pay the license fee. "The designated technology licensing organization" is the organization that is set or given its exclusive license of intellectual property rights owned by the first and gives it to a third party, but not to the first. (Feedback of Information of Performance) Paragraph 3 The second should offer the information on the usage of the contents to follow the request of administrator. (Limitation of Publishing or Offering it to a Third Person) Paragraph 4 The second should not publish the contents nor offer it to a third person. (Limitation of Publishing the Improved Contents or Offering it to a Third Person) Paragraph 5 The second should not publish the improved contents nor offer it to a third person except for the purpose of using or improving that is defined in paragraph 2. When the second offers it to the third person in question, and make the third person observe the same requirements from paragraph 1 to paragraph 5. (Limitation of Guarantee) Paragraph 6 The first does not guarantee any results during the usage of the contents. The second should be responsible for all usage of the contents. (Limitation of Maintenance) Paragraph 7 The contents should be offered in its present state, and the first does not offer any kind of maintenance. (Obligation to Observe the Agreement of Original Contents) Paragraph 8 If the contents is developed with the improved software of a third person, the second should observe the agreement of the original contents. (Obligation to Refer to the Related Papers) Paragraph 9 If the second investigates and develops something with using the contents and publishes the results, the second should refer to the related papers that specified by the first. (Agreement of Jurisdiction) Paragraph 10 The first and the second will fix the jurisdiction of a first instance about this agreement with Tokyo district court.
